Real Time Information Payroll Legislation

With the exception of a very small number of organisations, which you can find out more about here, all employers must send information to HMRC either online or via an electronic data interchange (EDI) every time the payroll is run. This is known as real time information or RTI.

The following is a closer look at your real time information responsibilities as an employer, along with some details about how Primo Payroll can take over your compliance responsibility on your behalf.

What information do you need to submit?

Full Payment Submission (FPS)

You will also need to complete an FPS, which lets HMRC know how much money you have paid and deducted for each payroll run. This should be submitted after each weekly or monthly period, depending on the frequency of your payments. You can complete multiple full payment submissions for the same tax period.

This should include:

  • Starter and leaver information
  • Employee PAYE and NI contributions for the year to date
  • Employee net pay
  • Employee name, NI number, gender and address
  • Company PAYE reference
  • Accounts office reference
  • Tax office number
  • Tax and NI contributions due

Employment Payment Summary (EPS)

This is an optional submission that only needs to be made if you have recoveries on statutory payments such as sick pay, maternity pay, paternity pay or the Construction Industry Scheme. Your EPS should be submitted monthly. If you complete multiple employment payment summaries for the same tax month, only the last submission will be recognised by HMRC.

The EPS should include:

  • Statutory payments recovered
  • NI contributions compensation on statutory payments
  • Advance funding obtained from HMRC for tax refunds and statutory payments
  • CIS deductions incurred
